Loss of chance claims in clinical negligence

In this webinar, we will look at the concept of “loss of chance” which is an important concept in Australian medical negligence law.

Event Details


Loss of chance claims involve an allegation that a patient has lost the chance of a better medical outcome, in terms of treatment and/or prognosis, as a result of the negligence of the medical practitioner. This concept has been used in medical negligence claims and in other causes of action where there is actual loss, which is nonetheless difficult to quantify with any precision.

Join our Head of Insurance Damien van Brunschot, and Senior Associate Luke Gollan, as they look at the general principles of loss of chance with a focus on clinical negligence matters, and how these principles have been applied by the Australian Courts in recent cases.
