England and Wales
The new bands are as follows:
- Lower band – £900 to £8,800 for less serious cases
- Middle band –£8,800 to £26,300 for cases that do not merit an award in the upper band
- Upper band – £26,300 to £44,000 for the most serious cases
- Exceptional cases – £44,000 or above
The new bands apply to claims presented on or after 6 April 2019 and will be reviewed annually.
Scotland
In respect of claims presented in Scotland, the bands remain subject to paragraph 12 of the Presidential Guidance issued on 5 September 2017. The Guidance states that if the tribunal decide that the Simmons v Castle 10% uplift should not apply, the award should be adjusted accordingly.
