Examples of Bill's professional indemnity experience includes:
- Claim against a national firm of surveyors arising out of the preparation of a building survey report. The central issue was causation, specifically whether the defects in the property could be remedied, or whether demolition and rebuild was the only viable option.
- Claim against a firm of solicitors arising out of advice on the purchase of a piece of land adjoining the client's garden. The land transaction developed into an acrimonious neighbour dispute. The client accepted a modest bagatelle payment in settlement of her claim under the LEI policy.
- Claim against a firm of solicitors arising out of advice on the sale of a parcel of land. The defendant failed to include a restrictive covenant preventing development of the land after sale. The measure of loss was a complex issue and a pre-action deadlock over the issue seemed inevitable. To break the deadlock we obtained valuation evidence supporting the client's case and made a reasoned Part 36 offer using the valuation evidence. The offer was accepted and the claim was settled at the pre-action stage.
