Building on the successful transfer of Hunterston B earlier this year, the completion of Hinkley Point B represents another major milestone in one of the most complex and strategically significant programmes currently underway within the UK nuclear sector.
DWF has acted as principal project counsel to NDA Group throughout the AGR transfer programme, advising on the extensive legal, regulatory, commercial and operational considerations required to facilitate the transfer of responsibility for the stations from EDF. The successful completion of the Hinkley Point B transaction follows years of planning, coordination and delivery across multiple workstreams and stakeholders.
The transfer enables NDA Group to progress the next phase of decommissioning activities, drawing on their specialist expertise to manage the long-term restoration of the site while supporting the government's broader energy and environmental objectives.
A truly multidisciplinary effort
The Hinkley Point B transfer required expertise from across DWF's legal and business services teams, with specialists from numerous practice areas working together to deliver advice covering commercial and contractual arrangements, together with associated regulatory and statutory considerations.
The project was led by Darren Walsh, Global Head of Energy at DWF, supported by a cross-disciplinary team of lawyers and specialists from across the firm. Drawing on expertise from multiple jurisdictions and practice areas, the team worked closely alongside the in-house legal teams at NDA Group to navigate the complexity of the transfer and ensure a seamless completion.
Commenting on the milestone, Darren Walsh, Partner and Global Head of Energy at DWF, said:
"The successful transfer of Hinkley Point B is another important milestone in the UK's nuclear decommissioning programme and demonstrates the strength of collaboration between NDA Group and all advisers involved.
This project has required an exceptional team effort over a number of years, bringing together specialists from across DWF to address a wide range of legal, regulatory and commercial challenges. We are incredibly proud to have supported NDA Group in reaching this latest milestone and look forward to continuing to support the wider AGR transfer programme."
The completion of the second AGR transfer further underlines DWF's position as a trusted adviser to organisations operating at the forefront of the energy and infrastructure sectors, supporting complex, nationally significant projects that contribute to the UK's long-term energy transition and decommissioning objectives.
