DWF, the global provider of integrated legal and business services, advised a consortium of Rubau Polska and Poltores Sp. z o.o., belonging to the Spanish construction group CONSTRUCCIONES RUBAU, on the tender procedures for the design and construction of two sections of the S-19 and S-10 expressway.
The DWF team in Poland advised a consortium of Rubau Polska and Poltores Sp. z o.o. on two tender procedures: (i) for the design and construction of the 15.8 km-long S-19 expressway from the end of the Wola Skromowska bypass to Lubartów in the Lublin Voivodeship, which resulted in the signing of a contract worth PLN 389m on 15 September 2022; and (ii) for the design and construction of the 11.8km-long S-10 expressway between the Toruń Zachód and Toruń Południe junctions in the Kujawsko-Pomorskie Voivodeship, which resulted in the signing of a contract worth more than PLN 339m on 20 January 2023.
During the tender process, which lasted almost a year, the contractor's offers were rejected several times by the contracting authority, however, thanks to a successful appeal strategy before the National Appeal Chamber, the contracting authority was ordered to annul the selection of the most favourable offer and at the same time, to annul the rejection of the consortium's offer. In the course of the contract award procedures, DWF in Poland supported the client in formulating answers to the contracting authority's questions, in representation in a number of hearings before the National Appeal Chamber, as well as in completing the formalities related to the signing of the contract agreement.
