When a worker is ill or injured, there a number of areas of law which come into play including employment, safety, and workers' compensation. This multifaceted legal nature, combined with the extensive legal protections afforded to such workers (in relation to unfair dismissal, general protections, discrimination, privacy and work health and safety), can sometimes make the management of injured workers a particularly complex area for employers. Unfortunately, failure by employers to properly navigate these protections can result in a range of unintended consequences and significant repercussions both culturally and commercially.
