Anthony is a Senior Associate and an experienced litigator having in excess of 20 years working in the legal profession advising Insurers (in Ireland and the UK) and Policyholders on Professional Indemnity Claims and Construction Claims. Anthony also provides Coverage Advice to Insurers.

Experience

Anthony primarily deals with claims and complaints (and has resolved many pre-action) against Solicitors, Accountants, Insurance Brokers, Architects, Engineers, Surveyors, Valuers, IFAs, and Stockbrokers, as well as a number of the “new” and “emerging” professions. In addition, Anthony also provides detailed coverage advice to Insurers. He advises on liability and defence litigation strategies for commercial dispute claims and works with both Insurers and Policyholders, as well as keeping Insurance Brokers updated while providing top class advice to his clients on how to limit indemnity claims on the best commercial terms available with very favourable results.

Some key cases upon which Anthony has advised include:

  • Acting on the instructions of both Primary Layer Insurers and Excess Layer Insurers to represent the Partners and former partner of a firm of prominent Solicitors who were joined, as Third Parties, to a set of recovery proceedings taken by a Receiver, on behalf of two lending companies, against an individual who subsequently joined a Policyholder as a third party for alleged professional negligence in the provision of advices relating to the transfer of a family home as security for a loan which ultimately resulted in a claim valued at €4.5 million. The Policyholder was extracted from the proceedings after an extensive mediation for a minimal "all in" (costs-inclusive) contribution.
  • Acting for a prominent firm of Architects who were joined, as Third Parties, to a set of complex proceedings taken by the neighbour of an adjoining house which the Policyholder was working on. Initially, proceedings were issued against the owners of the adjacent building and subsequently the builders were added to the proceedings; and they in turn added the Policyholder and a number of other parties, as Third Parties. Due to the high number of parties involved in the litigation, the matter became very complex with a significant number of experts involved. The matter was settled for a minimal contribution on the best commercial terms available.
  • Acting for an international firm of Accountants who were co-defendants in an action as a result of the provision of allegedly-incorrect tax advice. The value of the claim was significantly reduced due to the strategic advices provided and intensive negotiations at settlement talks. By intervening at an early stage, Insurers obtained a very substantial discount in what otherwise would have been a very difficult, long, and drawn-out, and very costly, litigious matter, whilst also preserving the Policyholder's reputation.

Anthony has extensive experience working in all Court Jurisdictions to include attending before the Irish Supreme Court. He has successfully resolved a number of international disputes attending before the Irish Commercial Court. Anthony also has experience in other forums of dispute resolution, including Mediations, Reconciliations, and Arbitrations, as well as attending without prejudice settlement discussions.

Memberships

Anthony is a qualified Solicitor in Ireland. He is a member of the Law Society of Ireland. He is also a member of the Southern Law Association in Ireland to facilitate any regional based claims as well as being a member of the Irish Insurance Institute. He is currently working towards a CIP Qualification so as to ensure the best quality advice for Insurance-based clients.
