The Attorney General’s Legal Risk Guidance is a core document for lawyers advising on public sector matters because it sets out how to identify, assess, and manage legal risks as part of the decision-making process. The new Labour government has revised this guidance, changing some of the categories and emphasising the importance of the rule of law. The guidance also contains a definition of when advice should state that a proposed course of action is unlawful and expressly states that the government is obliged to honour legal obligations arising under domestic and international law.

Following on from the announcement made by the UK Parliamentary Secretary for the Cabinet Office on 12 September that that the commencement of the main operative provisions of the Procurement Act 2023 were to be delayed until 24 February 2025, the secondary legislation to give effect to this has now been made and it provides contracting authorities with some certainty as to this date.
